By using the Services, you acknowledge that you have read and understand this Privacy Policy. If you do not agree, please do not use our Services.

We collect several categories of personal information from and about you for the purposes described in this Policy. The types of information we may collect include:

    • Place an order on our website (e.g., entering your name, address, email, and payment details at checkout).

    • We use Meta Pixel (Facebook Pixel) on our site, which automatically collects data about your browsing actions on clepon.com. This allows us to measure the effectiveness of our ads and deliver relevant advertisements on Facebook/Instagram.

  • From Third-Party Sources: We may also collect information about you from other sources, including:
    • Shopify: Our online store is powered by Shopify. When you make a purchase or provide information on clepon.com, that data is collected through Shopify's e-commerce platform and provided to us to fulfill your order and manage our Services. Shopify acts as our service provider in processing this data.
    • Advertising and Analytics Partners: We might receive aggregated or anonymized insights from partners like Google or Meta about how users interact with our site or ads (for example, overall website traffic reports or information on the results of an ad campaign).
    • Social Media: If you engage with our brand on social media (such as by commenting on our posts or tagging Clepon in your content), we may receive information such as your social media username and any content you share with or about us, subject to the platform’s privacy settings.
    • Other Partners: If we run a joint promotion or event with another organization, the information you provide may be shared with us by that partner, as permitted by law and disclosed to you when you sign up.

This includes maintaining your account, if you have one, and generally making sure the website and store function properly for you.

For example, we might email or call you about questions related to your order or to respond to a query you sent us.
  • Marketing and Promotions: With your consent (where required), we use your email or other contact information to send you newsletters, product updates, special offers, or promotional messages about Clepon that we believe may interest you. You will only receive these communications if you have opted in, and you can opt out at any time.

  • Do Not Track: Some browsers have a “Do Not Track” feature that can send a signal to websites indicating you do not wish to be tracked. There is currently no industry standard for how websites should respond to DNT signals. Therefore, we do not respond to DNT browser signals. However, as mentioned above, we do respond to specific opt-out tools and signals (like the Global Privacy Control for California residents).

6. Sharing of Data with Service Providers

When you enter your credit card or payment details, that information is sent directly to the payment processor, which then tells us whether the payment was approved. We only receive limited information back (like a transaction ID and confirmation of payment).
    • Shipping Partners: We provide your name and shipping address (and contact info if required for delivery) to shipping companies (e.g., USPS, UPS, FedEx) or fulfillment centers that send you the products. They use this info solely for delivery purposes.
    • Email and Marketing Services: If you’re on our email list, your name and email are stored with an email service provider that sends out our newsletters and promotional emails. They help us design emails, manage subscriptions and opt-outs, and track email analytics (like open and click rates).
    • Analytics and Advertising Services: We allow certain partners to collect data via our site for analytics and advertising (as detailed in Section 5). For example, Google Analytics processes site usage data and provides us with reports. Facebook (Meta) processes data via the Pixel to help deliver our ads on their platform. These partners act based on our instructions (to an extent) and pursuant to their own privacy commitments.
    • Others: We might also share data with cloud storage providers (to securely store data, including backups), customer service platforms (to organize and respond to support inquiries), and fraud prevention services (to identify suspicious transactions). In all cases, these providers are given only the information necessary to perform their functions, and they’re contractually obligated to protect your data.
  • Affiliates: If Clepon ever has subsidiaries, parent, or affiliated companies, we may share your information within that corporate family to streamline operations and provide consistent service. Any affiliate receiving your information would abide by the same privacy commitments. (Currently, our brand is owned by Logos Keystone LLC, and any internal sharing is limited to that context.)
  • Business Transfers: In the event of a merger, acquisition, bankruptcy, or sale of Clepon’s assets, customer information is typically one of the business assets transferred. If such a transfer occurs, the successor company can only use your information in line with this Privacy Policy (unless you agree otherwise). You would be notified via our website or email of any change in ownership or control of your personal information.
  • Legal Compliance and Protection: We may disclose information about you if required to do so by law or in response to valid requests by public authorities (e.g., a subpoena, court order, or government demand). We may also share information when we believe it’s necessary to:
    • Investigate, prevent, or take action regarding suspected illegal activities or fraud (for example, sharing information with law enforcement or credit card companies when investigating fraudulent transactions).
    • Enforce our terms of service or other agreements (e.g., sharing data with a collection agency for unpaid debts, or with our legal counsel for contract enforcement).
    • Protect our rights, property, and safety, or those of our users, employees, or others. For instance, we might provide information to law enforcement if someone poses a threat to public safety or if information is needed in relation to a crime.
  • With Your Consent: Aside from the reasons above, we will share your personal information with third parties if you have given us explicit permission. An example might be if you ask us to share your testimonial on our social media pages, or if you participate in a joint marketing event and instruct us to share your info with the co-sponsor.

Importantly, Clepon does not sell your personal information to third parties for their own marketing use. We also do not share your data for cross-context behavioral advertising without your opt-out (as described above). Any sharing that occurs is mainly with service providers acting on our behalf, or for the other reasons listed (legal compliance, etc.).

7. Legal Bases and Consumer Rights

We handle personal data under certain legal grounds and respect your rights under privacy laws like CCPA (California), VCDPA (Virginia), and CPA (Colorado). Below is an overview:

Legal Bases for Processing: (Primarily relevant for EU/UK standards, but we include them for transparency.) We ensure we have a valid reason to use your data:

  • Contractual Necessity: To fulfill our contract with you. Example: when you buy a product, we use your address to ship it and payment info to process payment.
  • Legitimate Interests: We may use your data for our legitimate business purposes, like improving our services, preventing fraud, or sending marketing to existing customers. We only do so after considering potential impacts on your privacy and ensuring it doesn’t override your rights.
  • Legal Obligation: Some uses of data are required by law. Example: maintaining transaction records for tax purposes or providing information in response to a legal subpoena.
  • Consent: In cases where we rely on your consent (e.g., sending promotional SMS, or using certain cookies), you have the right to withdraw consent at any time.

Your Privacy Rights (California, Virginia, Colorado): Depending on your state of residence, you may have some or all of the following rights regarding your personal information:

  • Right to Know/Access: The right to request that we disclose what personal information we have collected about you, including specific pieces of data and general details like categories of data, sources, purposes, and third-party disclosures.
  • Right to Delete: The right to request deletion of personal information we collected from you, subject to certain exceptions (for instance, we might keep data required for completing a transaction or for legal compliance).
  • Right to Correct: The right to ask that we correct inaccurate personal information we hold about you.
  • Right to Opt Out of Sale/Sharing: The right to direct us not to sell your personal information or share it for targeted advertising purposes. As noted, Clepon doesn’t sell data for money, but if you want to opt out of data sharing via cookies for ads, we will honor that (see Section 8 on how to exercise this right).
  • Right to Opt Out of Targeted Advertising: (For Virginia/Colorado) The right to opt out of the use of your data for targeted advertising (which is analogous to the above).
  • Right to Opt Out of Profiling: The right to opt out of any profiling using your personal data in furtherance of decisions that produce legal or similarly significant effects. (We do not currently do this kind of profiling.)
  • Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising any privacy rights. We will not deny you goods or services or charge you a different price because you exercised your rights.
  • Right to Appeal: If we refuse a request you made (where a law like VCDPA provides this right), you can appeal our decision (Section 8 describes the process).

These rights are subject to verification and legal limitations. Please see Section 8 below for how to submit requests and our verification process.

8. Exercising Your Rights

If you wish to exercise any of the privacy rights described above, you may contact us through the following methods. We will need to verify your identity to process certain requests, which is for your protection:

  • Email Us: Send an email to info@clepon.com with the subject line “Privacy Request.” In the email, let us know which right you want to exercise (e.g., “I’d like a copy of my data” or “Please delete my personal information”). Include your name and the email address associated with your Clepon orders or account.
  • Contact Form: If available, submit a request through our website’s contact form. Indicate that it’s a privacy-related request and specify what you need.

Verification: To protect your information, we will verify your identity before fulfilling requests. We may ask you to confirm a piece of information we have on file (like a recent order number or the last four digits of your phone number). For more sensitive requests (like accessing detailed data or deleting an account), we might require multiple pieces of verification. If we cannot verify your request, we will let you know.

Authorized Agents: California residents can designate an authorized agent (e.g., an attorney or other representative) to submit requests on their behalf. If you use an agent, we will require proof of authorization (like a signed permission from you) and will still need to verify your identity directly (or verify the agent’s authority through you).

Response Time: We aim to respond to privacy requests within 45 days of receiving them. If we need more time (up to an additional 45 days, for a total of 90 days), we will inform you of the extension and the reason. If we cannot fulfill your request for a valid reason (e.g., an exemption under the law), we will explain that in our response.

Appeals (Virginia/Colorado): If you’re unsatisfied with our response to your request, you may appeal by contacting us again (preferably via the same channel) and stating that you are appealing our decision. We will re-evaluate your request and respond to the appeal within the timeframe required by law (generally 45 days). If you remain unhappy after the appeal, we will provide information on how you can contact your state’s Attorney General or relevant supervisory authority.

9. Children’s Privacy

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not use our site or provide any information about yourself (such as your name, address, or email).

If we learn that we have inadvertently collected personal information from a child under 13, we will delete that information as soon as possible. Parents or guardians: if you believe your child under 13 may have provided us with personal information, please contact us at info@clepon.com, and we will promptly investigate and address the issue.

For teens under 18, we recommend using our Services only with parental involvement. Some content or products may not be suitable for minors, and we do not knowingly market to minors. California residents under 18 who are registered users of our Services can request removal of content or information they have publicly posted by contacting us.

10. Data Security

We implement a variety of security measures to safeguard your personal information:

  • Payment Security: We do not store your full payment details on our systems. Payment transactions are processed by third-party payment providers that specialize in secure payment processing and are PCI-DSS compliant. For instance, when you enter your credit card info at checkout, it is transmitted directly to the payment processor; we receive a token or confirmation rather than the card number itself.
  • Monitoring: We monitor our systems for potential attacks or breaches. We also maintain incident response plans in case of any security events.

However, please note that no e-commerce platform or method of data transmission can be guaranteed 100% secure. We encourage you to take precautions as well:

  • Keep your account password confidential and use a unique, strong password.
  • Avoid sharing personal data in forums that aren’t protected (like public social media comments or non-secure emails).
  • Be aware of potential phishing attempts – Clepon will never ask for your password via email, and any communication asking for sensitive info in an unusual way should be verified.

In the unlikely event of a data breach that affects your personal information, we will notify you and any applicable regulators as required by law. We appreciate your trust and work hard to maintain the security of our systems.

11. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which we collected it, unless a longer retention period is required or permitted by law. How long we keep your data depends on the type of information and the purposes for which we use it:

  • Transactional Records: We keep records of your purchases (order history, invoices, payments, correspondence regarding orders) for a period required by tax and accounting laws, typically at least 7 years. This is both for legal compliance and to have an accurate history to serve you better (returns, customer service).
  • Account Information: If you have an account with us, we retain your account information until you delete the account or it’s inactive for an extended period. Even if you delete your account, we may keep certain information (like order history linked to an internal customer ID) for legal or record-keeping purposes.
  • Marketing Data: If you’ve consented to receive marketing communications, we keep your contact details and preference info until you unsubscribe or request deletion. If you opt out, we will place your email on a suppression list to ensure we don’t accidentally email you, which we maintain as needed.
  • Cookies and Tracking Data: Cookies have varying lifespans. Some cookies (session cookies) are deleted when you close your browser, while others (persistent cookies) remain for a set period (e.g., a few days, months, or years). You can clear these at any time via your browser settings, which removes them from our and our partners’ systems.
  • Legal Holds: We might need to retain certain data if required for legal proceedings or if retention is mandated by law (for instance, information involved in a dispute may be held until resolution, even if you would otherwise have the right to deletion).

After the retention period, or if data is no longer needed, we will either delete it or anonymize it (so it can no longer be associated with you). We use secure methods for deletion in accordance with industry standards. Please note that backup archives may retain data for additional time until they are cycled out; however, we have safeguards to prevent restoring archived data except as needed for disaster recovery or law compliance.

Our website or communications may contain links to websites, content, or services operated by third parties (not affiliated with Clepon). Examples include:

  • Links to articles or blogs that discuss health topics or ingredients, which are hosted on external sites.
  • Social media icons or links that take you to Clepon’s pages on platforms like Instagram or Facebook.
  • Links to third-party payment options (like PayPal) or review sites.

If you click on these links, you will be directed away from Clepon’s site to a third-party site that we do not control. We encourage you to review the privacy policies and terms of use of every third-party site or service you interact with. We are not responsible for the content, security, or privacy practices employed by these third parties.

For example, if you follow a link to an article on “Health Benefits of Vitamin D” on another company’s blog, any information you provide or that is collected by that blog is governed by their privacy policy, not ours. Similarly, any interactions you have on social media platforms (like leaving a comment on our Instagram post) are subject to the privacy and data handling practices of those platforms.

In summary, this Privacy Policy applies only to Clepon’s Services. Once you leave our website or otherwise interact with a non-Clepon entity, we are not responsible for how that entity handles the personal information you provide to them or that they collect automatically.

13. Financial Incentive Disclosures

Clepon may offer special deals or benefits in exchange for certain personal information. For instance, we might provide a one-time discount if you sign up for our email newsletter. Under laws like the CCPA, this could be considered a “financial incentive” since we’re offering a benefit (discount) for personal data (your email).

How Our Incentive Programs Work:

  • When you provide your email to sign up for a discount, you’ll typically receive a promo code (e.g., 10% off) that you can use on your purchase. By signing up, you’re also agreeing to receive our marketing emails. These may include product news, promotions, and other updates. You can unsubscribe at any time using the link in those emails or by contacting us.
  • Your participation is voluntary. You can choose not to opt in, and you will still have access to our products at regular prices. If you do opt in, you have the right to opt out of the program later (for example, you can unsubscribe from our emails after using your discount code). If you opt out of the emails, we will stop sending you promotional messages, and you would no longer receive exclusive subscriber offers (if any ongoing ones exist beyond the initial discount).
  • We do not treat customers who exercise their privacy rights differently. That means if you sign up for the newsletter and later opt out, we won’t penalize you (apart from not sending emails, which is what you requested). Similarly, if you decide not to provide your email for a discount, you’ll just pay normal prices, and we won’t refuse service or alter your experience other than not providing the incentive.
  • Any financial incentive offer will have terms that describe the nature of the incentive. For example, “Sign up and get 10% off your first purchase. Essentially, if we offer a 10% discount on an average $50 order (value $5), we anticipate that having the ability to send you marketing emails is worth at least that $5 to us in future revenue or brand engagement.

Your Rights Regarding Incentives: You can opt in by providing the requested data (like your email) and opt out by withdrawing that data (unsubscribe). If you have any questions about a particular incentive or want to know how your data is handled in such programs, you can refer to the specific terms provided at sign-up or contact us for more information. We will never force you into an incentive, and you can always change your mind.
